Anthony Waites and Mark Timpson died in a fire at a flat above the Spar Shop in Castle Hill Parade, Ealing on 9 September 1996. A man was to be tried but was found to be too ill to stand trial.

The man, a 61-year-old minicab driver, was initially set to be tried in September 1998, but the case was stopped due to his health. However, after he was filmed running a mini-cab business and gambling at casinos he was set to be tried again, but the trial was again halted after details of his organic heart disease were heard. It was said that he was so ill that if he were tried he would have to be taken to the hospital every few hours. It was heard that he would have had to have been monitored all the time at the trial and that at the first mention of his disease, or discussion of it, he would have had to be have been admitted back to hospital. The judge also noted that the police had told him that the man had not been seen recently working as a mini-cab driver or going to casinos.

It was said that he had set fire to a Spar supermarket in Ealing, West London run by his ex-lover in the early hours of 9 September 1996 after she refused to marry him.

The man was facing two charges of manslaughter and two of arson being reckless as to whether life is endangered.

Anthony Waites and Mark Timpson lived above the shop and both died in the fire.
