James Baillie was killed in a fight with a number of men in Hamilton, South Lanarkshire, on 23 July 2013. He was attacked around 9pm.
A man was tried but the case was found not proven. The man, an ex-boxer, lodged a special defence of incrimination against his brother and two other men.
James Baillie had been with his 64-year-old mother when he was attacked. They had been involved in a row with several other people in Buchanan Crescent at about 9pm, during which James Baillie received a serious head injury. His mother also received serious injuries to her arm, head and face.
James Baillie was taken to Hairmyres Hospital in East Kilbride where he died three days later on 26 July 2013.
It was also heard that James Baillie had been assaulted earlier on in the evening in Buchanan Crescent.
