Derrick Shaw was punched outside the Favourite Chicken shop near Redhill station on 26 October 2002 and died five days later in hospital.

A man was tried twice for his manslaughter but the juries were unable to agree on a verdict. It was said that traditionally people are not tried for a third time when juries fail to agree.

It was said that the man that was tried, who was a trained martial artist was fired up for a fight and had made racial comments to Derrick Shaw. In court, he said that he had acted in self-defence.

The man punched Derrick Shaw causing him to fall and hit his head on the pavement. He suffered from swelling of the brain and died.

The prosecution said that the man had been heard to call Derrick Shaw a nigger after he had knocked him to the ground.

The man said that he had seen Derrick Shaw arguing with another man in the Favourite Chicken shop and that he had been gesturing for the man to go outside with him and that when Derrick Shaw went outside he turned on the man, who said that he had laughed at him, and tried to bite his nose. The man said, 'He went at my face. His teeth touched my nose. I pulled away. I just reacted. I was defending myself. I just lashed out. I was scared for myself. I did not think about it. I did not think he would go down. There was no way I was being racist, especially not to someone lying on the floor'.

The man said that after he hit Derrick Shaw he went into a state of shock and went home.
