Charles Tunnel was run over at night as he walked along the Brighton to Newhaven road on 7 September 1924.
A motorcyclist was charged with his manslaughter but was later discharged.
Charles Tunnel had been a shepherd from Rodmell.
The court heard that the motorcyclist, a dentist of Western Road, Brighton, had met with an accident on the Brighton to Newhaven road on 7 September 1924 and that the following morning Charles Tunnel was found lying dead at the bottom of a bank by the roadside near the scene of the accident.
When the case came before the magistrates they dismissed it, stating that no jury would convict on the evidence before them, and when it came before the Sussex Assizes on Wednesday 10 December 1924 the prosecution offered no evidence and the motorcyclist was discharged.
