Frederick Scott was murdered in a burglary.
It was heard that he was stabbed to death by one of two men that burgled his house. One of the men was tried but acquitted. However, both the men were convicted for the burglary.
The man that was tried for the murder was sentenced to 7 years whilst the other man was sentenced to 18 months. The man that was sentenced to 7 years later appealed stating that he had been convicted of the same burglary as the other man that was sentenced to only 18 months and that it appeared that he was being punished for the murder even though he had been acquitted. His sentence was then reduced to 5 years.
The judge said that it was plain that there had been a miscarriage of justice as clearly one of the two men had stabbed Frederick Scott.
