Aiden Cairns died at the Royal Preston Hospital after being found not breathing at an address in Church Street, Preston.
A man and a woman were arrested on suspicion of murder and the man was later charged with his murder, but when the case came to court the prosecution offered no evidence. A charge of neglect was also withdrawn.
The post mortem stated that the child died from smothering and asphyxiation.
However, the court heard, in 2016, that there was no evidence to show that the man deliberately or accidentally injured Aiden Cairns.
