John Martin died after an alleged assault by his two sons.

His two sons were tried for his manslaughter on 22 October 1920 at the Central Criminal Court in London but were acquitted. The sons were aged 20 and 26 years.

It was said that during the course of an altercation that one of the sons had rushed at John Martin and that the other son had then joined in causing John Martin to fall, causing concussion and fracture of the skull from which he later died.

However, no one saw the son's strike John Martin and they both gave evidence denying the charge.
