Arthur Holscher-Ermert was knocked down.

A policeman was to be tried for causing his death but the prosecution offered no evidence after it was heard that expert reports had concluded that if he had not steered towards Arthur Holscher-Ermert, that he might have otherwise crashed.

The prosecution had claimed that the policeman had steered towards Arthur Holscher-Ermert in an effort to stop him running away.
