Frank Smith died after he was put out of a car naked, except for a black plastic bag.
Three men was alleged to have kidnapped and robbed him, and then dumped him on the M57 naked as a punishment for alleged remarks about the common-law wife of one of the men.
However, the men claimed that the abduction was a prank.
Frank Smith was later found by a police patrol in a distressed condition at Prescot and collapsed and died.
However, after receiving the evidence against the men, the Director of Public Prosecutions declined to continue with the case. The prosecution said:
Frank Smith had been a musician and had lived in Netherley.
