George Robertson was knocked over on the B792 between Bathgate and Torphichen in West Lothian on 20 September 2020.
It was thought he had been hit by a Nissan Qashqai car as he was walking along the road.
He was found injured in the road and taken to hospital by his family but died there two hours later.
Two people were arrested in July 2021, but the Crown Office ruled that there was insufficient admissible evidence to commit them for trial.
It was heard that the two people, a couple, were linked to the scene by mobile phone and bank account records and that the police had even traced the vehicle that they had been driving in with the help of Nissan in Sunderland.
However, the couple refused to speak to the police and no further developments were made.
An appeal against the decision not to prosecute the couple was made but it was rejected in January 2022.
It was reported that the family of George Robertson were considering a private prosecution or a civil lawsuit but nothing more is known.
